PTI chairman to remain in Attock jail despite Toshakhana sentence suspension

A special court in Islamabad has directed Attock Jail authorities to detain the PTI chairman, Imran Khan, in judicial custody in the cipher case. This decision follows the Islamabad High Court’s suspension of Imran Khan’s three-year sentence in the Toshakhana case.

A letter addressed to the Attock jail superintendent orders the appearance of Imran Khan on August 30 for his involvement in the cipher case. The letter states that , “Imran Khan is hereby ordered for judicial remand in case FIR mentioned above, who is already detained in district jail, Attock.”

Earlier, Imran Khan and PTI leader Shah Mahmood Qureshi were named in an FIR registered on August 5 under the Official Secrets Act.

The IHC’s succinct verdict ordered the release of the PTI chairman on bail from Attock Jail, with detailed reasoning to be provided later. Imran Khan had contested the trial court’s  denial of his right to defense in the Toshakhana case at the Islamabad High Court. He pleaded for the restoration of his right to defense and requested immediate consideration.

In the Toshakhana case, the District and Sessions Court sentenced Imran Khan to a three-year jail term on August 5, along with a fine of Rs 100,000. The court also disqualified the former prime minister from holding public office for five years. The court found him guilty of submitting fabricated details of Toshakhana gifts to the Election Commission of Pakistan, involving corrupt practices.

The anticipated Toshakhana case verdict was delivered by an IHC division bench comprising Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahangiri in response to the former prime minister’s appeal against his prison term. The IHC’s initial verdict ordered Imran Khan’s release on bail from Attock Jail, with a detailed explanation to follow.

In summary, Imran Khan’s imprisonment in the Toshakhana case was suspended by the IHC. A special court directed his detention in the cipher case, while the IHC order for his release on bail was issued earlier. The Toshakhana case had led to a three-year jail sentence, a fine, and disqualification from public office for Khan.
